Liability In Firefighter Fall Cases

Fires are chaotic and fraught with peril, and firefighters are required to operate in punishing conditions on stairways, fire escapes, and roofs, all of which pose a risk of injury from a fall. Firefighters who are injured in a fall are entitled to sue under these circumstances:

  • Legal Violation — If a landlord violated the law, and that violation caused the firefighter to fall and sustain an injury, the firefighter may sue the landlord under General Municipal Law § 205-a. This could come into play if a structure, such as a deck or fire escape, was not up to code and collapsed.
  • Premises Liability — If the landlord was negligent in failing to correct a hidden hazard, and the hazard caused the firefighter to fall and sustain an injury, the firefighter may bring a negligence action pursuant to General Obligations Law § 11-106.
  • Faulty Equipment — If an equipment failure gave the firefighter no choice but to exit a building causing the firefighter to fall, the firefighter may have an action against the equipment manufacturer. For example, if the oxygen from a self-contained breathing apparatus (SCBA) suddenly cut off, and the firefighter could not remain in a smoky building, the manufacturer of SCBA might be liable. If a firefighter was injured because the hydraulic mechanism on the telescopic aerial platform did not function, the firefighter might have a case against the manufacturer of the equipment or the department for failing to maintain that equipment.
  • Firehouse Slip-and-fall — If a firefighter is not responding to an emergency, but is simply attending to routine duties in the firehouse and a hidden defect in the firehouse causes a slip-and-fall injury, the firefighter may be able to sue the fire department.
